What a Florida claim actually covers

Beyond emergency care and follow-up treatment, a claim can include future medical costs, lost wages and lost earning capacity, out-of-pocket expenses, vehicle damage, and non-economic damages for pain, disability, disfigurement and loss of enjoyment of life. A spouse may hold a separate claim for loss of consortium.

Those categories are easy to leave money in when nobody itemizes them — which is exactly why a first offer arrives so fast.

Miss that window and your Personal Injury Protection coverage — up to $10,000 with an emergency medical condition diagnosis, $2,500 without — can be denied outright, leaving you personally responsible for the bills.
2 YearsTo file a negligence lawsuitHouse Bill 837 cut Florida's negligence deadline from four years to two, effective March 24, 2023. Claims arising on or after that date now expire in two years; wrongful death is two years from the date of death. Claims involving a government entity carry their own, shorter notice requirements.

The call you shouldn't take

Adjusters ask for a recorded statement early, while you are medicated and before anyone knows whether that shoulder needs surgery. Nothing in Florida law requires you to give one to the other driver's carrier. Once you are a client here, those calls come to us instead of you.

If someone told you it was your fault

Under the modified comparative negligence standard adopted in 2023, a person found more than 50% at fault recovers nothing. That is precisely why insurers now push blame onto injured people harder than they used to. Being told the wreck was your fault is a reason to call, not a reason not to.

+How much does it cost to hire you?

Nothing up front. We work on a contingency fee, which means our fee comes out of the recovery and there is no fee at all if we don't recover money for you. Clients may still be responsible for case costs; we walk through exactly what that means, in writing, before you sign anything.

+The insurance company already called me. Should I give a statement?

Not before you speak to a lawyer. Nothing in Florida law requires you to give a recorded statement to the other driver's carrier, and those calls come early precisely because nobody yet knows how serious your injuries are. Once you are a client here, the adjuster calls us instead of you.

+What if I was partly at fault?

You may still recover. Under Florida's modified comparative negligence standard, adopted in 2023, your recovery is reduced by your share of fault, and only a person found more than 50% at fault recovers nothing. Insurers push blame onto injured people precisely because that threshold exists. Being told it was your fault is a reason to call, not a reason not to.

+How long will my case take?

It depends on your treatment more than on the courts. Most cases resolve once doctors can say what your long-term prognosis is, because that is when the claim can be valued honestly. Straightforward claims can settle in months; cases involving surgery, disputed liability or a trial take longer. We will give you a realistic range on the first call and update it as the case moves.

+Do I have to go to court?

Usually not. The large majority of injury claims settle without the client ever testifying. We prepare every case as though it will be tried, because that is what moves an insurer's number — but the decision to accept an offer or go to trial is always yours, made with a clear picture of both.
